Alban Kang
Alban is one of the founding partners of the Singapore law firm of Alban Tay Mahtani & de Silva LLP (ATMD) and is currently the firm’s Managing Partner.

Experience
Alban is the Managing Partner of the Firm. He has been in legal practice for over 25 years. Alban has been recognised consistently as a leading practitioner in the field of Intellectual Property. He has been named as a leading individual for Intellectual Property law in Singapore in The Asia Pacific Legal 500 2007/2008 edition and consistently in the last 5 preceding editions. He has also been recognised for his expertise in Intellectual Property in AsiaLaw Leading Lawyers in the last 6 editions from 2002-2008.

Alban has also been consistently named as a leading Trade Mark Lawyer in International Who’s Who of Trademark Lawyers (2004, 2006, 2007 editions) and Guide To The World’s Leading Trade Mark Law Practitioners (2002, 2004, 2006 editions) as well as a leading Patent Lawyer in the Guide To The World’s Leading Patent Law Experts (2001, 2003, 2005, 2007 editions). He is also listed as a Specialist Individual in the category of Trade marks/copyright (contentious) and Patents (contentious) in World IP Survey 2006.

He has also been recognised as a leading lawyer in IT in the Guide to the World’s Leading Technology, Media & Telecommunications Lawyers (3rd edition). Alban is also a Member of the Board of Directors of the Intellectual Property Office of Singapore (IPOS).

He is a founding partner of the firm and practices in the Intellectual Property and Technology Group which handles all aspects of intellectual property law, information technology and communications, computer law, advertising and entertainment law.

He represents major software companies, computer manufacturers, well known trademark owners, pharmaceutical companies, book publishers, international airlines and well known hotel chains, collection agencies and advertising agencies. He is currently involved in complex patent litigation and other contentious IP related cases.

He has written and presented many articles and papers on the various aspects of intellectual property law. He is also the author of the book “Enforcing Injunctions” and cocontributor of “Essays on Computer Law”, and general editor of “A Guide to Singapore Patent Law”. He is also the author of the Patent section of the “Halsbury Law of Singapore”.

Notable projects and clients
Recent projects include:

  • Represented Seiko Epson Corporation in a patent infringement matter.
  • Represented Philips Electronics in several patent infringement cases involving CD technology.
  • Represented a US client in a patent infringement case involving new water technology.
  • Represented the Aman Resorts successfully in the first case on well-known trade marks in Singapore.
  • Represented British Airways in its patent infringement claim against Singapore Airlines.
  • Represented a Singapore company in successfully revoking a patent before the Court of Appeal.
  • Represented John Robert Powers Finishing School in an “inverse passing off” case before the Court of Appeal.
  • Represented Levis Strauss Company in a trade mark infringement case.
  • Represented a client in a breach of confidence case before the High Court.
  • Represented a foreign mass transit operator in a copyright infringement case.
  • Represents the Entertainment Software Association (ESA) and co-ordinates its anticounterfeiting activities in Singapore.
  • Advises the Copyright Licensing Administration Society of Singapore (CLASS) in its licensing schemes with educational institutes.
  • Represents various other intellectual property associations in co-ordinating their respective anticounterfeiting activities in Singapore and in the region.
  • Advised a European consortium on the regulation of satellite transmission in Singapore.
  • Advised a major Hong Kong telecommunications company on establishing and maintaining business portals in Singapore and Malaysia.
  • Advising several Japanese multinational companies including NEC Corporation, Seiko Epson Corporation and Asia Matsushita on protection and enforcement of their intellectual property rights in Singapore and the region.

Professional background
Alban graduated from the National University of Singapore with a Bachelor of Laws (LLB (Hons)) and was admitted as an Advocate and Solicitor of the Supreme Court of Singapore in 1984. He also graduated from New York University with a Masters in Law in Intellectual Property (LLM (NYU) (Tr Reg)) in 1987. Alban was admitted to the New York State Bar in 1988 and as a Solicitor of England and Wales in 1997.

He is currently the Country Correspondent for European Intellectual Property Review and Managing Intellectual Property. He has written many articles on intellectual property and spoken at various conferences, including as a guest speaker at several WIPO seminars. Alban has been appointed to the International Trademark Association’s (INTA) International Panel of Neutrals.

Alban serves as a member of a number of committees including:

  • The Asian Patent Attorneys Association, Singapore Group
  • Association of Singapore Patent Agents
  • Information Technology Committee of the Singapore International Chamber of Commerce
  • Intellectual Property Committee of the Law Society of Singapore.
