Kuppan is a Consultant with the Dispute Resolution Group.
Experience
Kuppan has specialised in commercial litigation involving contentious and noncontentious work since 1991. His practice includes corporate and contractual disputes, competition law, contentious advisory work, insolvency work and disputes involving construction and building contracts.
He has presented papers at seminars and conferences on construction law and other litigation related topics, both in Singapore and abroad. He is also a part-time Tutor at the Postgraduate Practice Law Course organised by the Board of Legal Education.
Kuppan has worked with foreign counsels, including Queen’s Counsel and other specialist professionals on various matters and before a variety of tribunals. He has attended and worked on both local and international arbitrations. He has acted for clients in proceedings before the Court of Appeal, High Court and the Subordinate Courts.
Notable projects and clients
- Acted for and advised a Sectoral Regulator in Singapore’s first ever competition law appeal, heard before an Appeal Panel, set up by the Minister.
- Worked with competition law professors and economists from the UK on contentious competition law issues.
- Worked with and advised a Sectoral Regulator on training and implementing a whistleblower programme.
- Represented a US multinational corporation in the preparation and negotiation of a contract for the construction of a power plant.
- Acted as counsel in a major litigation arising out of share transactions relating to a Malaysian listed company, involving multiple issues of breach of contract, fraud and conspiracy with protracted hearings in the High Court.
- Acted for and advised a high profile client in a major litigation involving trust issues in the High Court, and in the Court of Appeal.
- Acted for and represented the Director of the Serious Fraud Office U.K. on disclosure of corporate documents in the possession of the Judicial Managers of Barings Futures (Singapore) Pte Ltd (Re Baring Futures (Singapore) Pte Ltd;
- Also advised a foreign regulatory body in its dealings with various Singapore Regulatory bodies, including the Commercial Affairs Department, Monetary Authority of Singapore and The Stock Exchange of Singapore Limited.
- Attended to and worked with U.S. counsel and consultants on an international construction arbitration held in the United States on design defects relating to a construction of a multi-million dollar plant in Singapore, with estimated quantum exceeding US$20 million.
- Acted for and represented a main contractor in an arbitration involving disputes relating to specialists subcontract works.
- Acted for and advised a foreign corporation in a shareholders dispute involving a Singapore company.
- Advised a French MNC over a dispute involving the construction of a wafer fabrication plant in Singapore.
- Advised and acted for numerous construction and corporate clients on insolvency matters, including acting for a bank in a matter involving cheque forgery.
- Represented and advised companies in judicial management issues including having appeared in court for companies under judicial management.
- Advised developers on the drafting of agreements relating to a resort project in Malaysia, as well as advising on management and co-ordination of litigation matters relating to the project.
- Acted for a major Japanese contractor in arbitration with developers relating to the construction of a resort in Indonesia, and facilitating successful settlement of the disputes including advice relating to the preparation of the claim for arbitration.
- Advised the management in design disputes for an international pharmaceutical company setting up facilities in Singapore, and on their dispute involving international Design Contractors.
- Drafted contracts for various projects including having advised on the construction of a pharmaceutical research facility in Singapore and on EPCM Contracts.
- Advised both corporate and individual clients on contractual issues, in which matters either proceeded to arbitration or litigation or were settled through negotiated settlements or mediation.
- Acted for and advised various corporations and financial institutions in respect of both contentious and noncontentious commercial and contractual claims.
Professional background
Kuppan graduated from the University of Hull, England, with a Bachelor of Law (LL.B (Hons) degree in 1988. He was called to the English Bar and admitted as a Barrister-at-Law, of the Middle Temple, England, in 1989.
Kuppan was admitted as an Advocate & Solicitor of the Supreme Court of Singapore in 1991 and he is also a Notary Public and a Commissioner for Oaths, Singapore.
